Terms of Service for Trackate

Agreement to Terms

By downloading, installing, or using Trackate ("the App," "our App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must not use the App.

These Terms apply to all users of the App, whether accessed via Google Play Store (Android) or Apple App Store (iOS).

About Trackate

Trackate is a mobile application designed for:

• Personal expense tracking
• Group expense management and bill splitting
• Debt tracking and settlement management
• Budget management and financial insights
• AI-powered expense categorization and analytics

Eligibility

To use Trackate, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the service under applicable laws
• Provide accurate and complete registration information

If you are under 18, you confirm that you have parental or guardian consent to use this App.

Account Registration

Creating an Account

You may register using:

• A valid email address and password
• Google Sign-In (via Google OAuth 2.0)
• Apple Sign-In (via Sign in with Apple, available on iOS)

Phone number and occupation are optional profile fields and are not required to create or use an account.

You must:

• Provide accurate, current, and complete information
• Keep your account credentials secure and confidential
• Accept responsibility for all activities under your account
• Not share your account with others

We reserve the right to suspend or terminate accounts that violate security policies or provide false information.

Account Security

You agree to:

• Maintain the confidentiality of your password
• Notify us immediately at support@svnate.com of any unauthorized access
• Not use another user's account without permission

User Obligations and Conduct

Acceptable Use

You agree to:

• Use the App for lawful purposes only
• Provide accurate expense and financial information
• Respect other users' privacy and data
• Settle debts and financial obligations in good faith
• Communicate respectfully with other users

Prohibited Activities

You must NOT:

• Use the App for fraudulent, illegal, or deceptive activities
• Impersonate others or create fake accounts
• Harass, abuse, threaten, or stalk other users
• Upload malicious code, viruses, or harmful content
• Attempt to hack, disrupt, reverse-engineer, or compromise the App
• Scrape, mine, or extract data without written permission
• Use automated tools (bots, scripts) to access the App
• Violate intellectual property rights
• Manipulate expense data to defraud other users
• Use the App for commercial purposes without prior written authorization
• Circumvent any security or access control measures

Services and Features

Core Features

Trackate provides:

• Personal expense tracking and categorization
• Auto-expense detection from payment notifications (Android only, optional)
• Group expense creation and management
• Automated bill splitting and debt calculation
• Budget management and alerts
• AI-powered expense categorization and insights
• Receipt storage and QR code expense sharing
• Friend connections and management
• Push notifications and reminders
• Location-based analytics (optional, with user permission)
• Bug reporting with screenshot attachments
• In-app feature tutorial for new users
• Siri Shortcuts (iOS only, optional): Log expenses hands-free via Siri voice or iPhone Back Tap without opening the app

Service Availability

• The App is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• Features may be modified, suspended, or discontinued at any time with or without notice
• Scheduled maintenance may temporarily limit access

App Updates

We may deliver app updates through:

• Android: Google Play In-App Update API (immediate or flexible updates)
• iOS: App Store updates prompted via in-app version checks
• Force Updates: We reserve the right to require mandatory updates when necessary for security, compliance, or critical bug fixes. If a force update is triggered, you must update the App to continue using it.

Financial Transactions and Debts

Expense Recording

• You are responsible for accurate expense entry
• Auto-detected expenses are suggestions only and require your review
• We do not verify the accuracy of expense data
• Expense records are for personal tracking purposes only

Auto-Expense Detection (Android Only — Optional)

By enabling auto-expense detection, you acknowledge and agree that:

• Explicit Opt-In Required: This feature is disabled by default and requires your explicit permission through Android Notification Access settings
• Notification Access: You grant the App permission to read notifications from 100+ whitelisted payment apps including major UPI apps (Google Pay, PhonePe, Paytm, BHIM, Amazon Pay, WhatsApp Pay), banks (SBI, ICICI, HDFC, Axis, Kotak, YES Bank, IndusInd, PNB, Bank of Baroda, Canara Bank, Union Bank, IDBI, and 30+ others), wallets (MobiKwik, FreeCharge, CRED, Airtel Payments Bank), neo-banks (Slice, Jupiter, Fi Money, Niyo), and SMS apps from all major phone brands
• Foreground Service: The App runs as a foreground service showing a persistent notification ("Trackate is monitoring expenses") when monitoring is active, for transparency and Android 16 compatibility
• Data Processing: The App extracts transaction information (amount, merchant, payment method, timestamp) from whitelisted notifications, processed locally on your device first
• Local Persistence: Transactions detected when the app is closed are temporarily saved locally (encrypted) to prevent data loss, then synced when you reopen the app
• No Guarantees: Auto-detected expenses are suggestions only; accuracy is not guaranteed
• Your Responsibility: You must review, verify, and categorize all auto-detected expenses
• Privacy: Only payment notifications from approved apps are processed; no raw notification text is stored; sensitive data (OTPs, card numbers, CVV, PINs) is filtered and never processed
• Revocable: You can disable this feature anytime in Settings or by revoking notification access in Android system settings

We are not responsible for missed, incorrectly detected, or duplicate transactions, or any financial decisions based on auto-detected data.

Siri Shortcuts (iOS Only — Optional)

Trackate provides an optional "Add Expense" Siri Shortcut that lets you log expenses without opening the app. It can be triggered by voice or by Back Tap (Settings → Accessibility → Touch → Back Tap). By using this feature, you acknowledge:

• Opt-in only: The shortcut is optional. You must grant Siri permission in iOS Settings to use it. Back Tap requires manual assignment in Accessibility settings.
• Trigger phrases: The following phrases invoke the shortcut via Siri — "Add expense in Trackate", "Add expense to Trackate", "Add a new expense in Trackate", "Log expense in Trackate", "Log expense to Trackate", "Track expense in Trackate", "Track expense to Trackate", "Record expense in Trackate", "Save expense to Trackate", "Enter expense in Trackate". Back Tap requires prior setup in iOS Settings → Accessibility → Touch → Back Tap.
• Authentication required: You must be signed in to Trackate before invoking the shortcut. The shortcut uses your stored authentication token to verify your identity.
• Data submission: Expense details you provide (amount, description, category, date) are transmitted to Trackate's servers over HTTPS to create the expense in your account.
• Voice processing: All speech-to-text is handled by Apple's Siri platform. Trackate does not receive or store any audio recordings. Back Tap invokes the same Siri parameter-collection UI.
• Accuracy: You are responsible for reviewing and correcting any expenses added via shortcut. Voice recognition errors may result in incorrect amounts or descriptions.
• Revocable: Revoke Siri access via iOS Settings → Siri & Search → Trackate. Remove Back Tap assignment via iOS Settings → Accessibility → Touch → Back Tap.

We are not responsible for expenses added with incorrect information due to voice recognition errors.

Debt Tracking

• Debt calculations are based on user-provided data
• Trackate does not facilitate, process, or guarantee actual payments
• Settlement of debts occurs outside the App between users
• We do not hold, transmit, or process any funds
• We are not liable for payment disputes or unpaid debts between users

No Financial Advice

Trackate is a tracking tool, not a financial advisor. We do not provide financial, legal, tax, or investment advice.

Advertising

The App displays advertisements provided by Google AdMob to keep the App free. By using the App:

• iOS: You will be presented with Apple's App Tracking Transparency (ATT) prompt before any advertising identifier is accessed. You may deny this permission without affecting core app functionality.
• Android: Ads may use your Google Advertising ID. You can opt out via Google Settings → Ads.
• You acknowledge that ad content is provided by third parties and we are not responsible for ad content.

User Content

Content Ownership

You retain ownership of content you upload (receipts, photos, expense descriptions). By using Trackate, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and process your content solely for the purpose of providing the App's functionality.

Content Responsibilities

You are responsible for:

• The accuracy of expense information you enter
• Compliance with applicable laws regarding uploaded content
• Not uploading illegal, offensive, defamatory, or infringing material

Content Removal

We reserve the right to remove content that violates these Terms, suspend accounts sharing inappropriate content, and report illegal content to authorities.

Privacy and Data Protection

Your use of Trackate is governed by our Privacy Policy, available at https://trackate.svnate.com/privacy-policy and within the App. Key points:

• We collect account information, financial data, device information, and optional location data
• We use Firebase (Google) for authentication, database, storage, messaging, and analytics
• We use Google AdMob for advertising
• We support Google Sign-In and Apple Sign-In for authentication
• We do not sell your personal information
• Your FCM token is deleted from our servers when you log out, preventing post-logout notifications
• You can delete your account at any time via Settings → Account → Delete Account inside the App

Intellectual Property

Our Rights

Trackate, its name, logo, and all content, features, and functionality are owned by SVNATE and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove copyright, trademark, or other proprietary notices
• Use our branding, name, or logo without prior written permission

User Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them to improve the App without any obligation or compensation to you.

Third-Party Services

Trackate integrates with the following third-party services, each subject to their own terms and privacy policies:

We are not responsible for the content, privacy practices, or terms of third-party services.

Disclaimers and Limitations of Liability

Disclaimer of Warranties

TRACKATE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR:

• Lost profits, revenue, or data
• Data loss or corruption
• Unauthorized access to your account
• Disputes between users
• Unpaid debts between users
• Inaccurate expense calculations due to user error or auto-detection errors
• Third-party service failures (including Google, Apple, Firebase, AdMob)
• Indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount you paid to use the App (if any) in the past 12 months.

User Disputes

You are solely responsible for resolving disputes with other users, settling debts, and verifying expense accuracy. We are not obligated to mediate user disputes.

Indemnification

You agree to indemnify, defend, and hold harmless Trackate, SVNATE, its developers, officers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your infringement of third-party rights
• User disputes and debt obligations
• Your content and data

Account Termination

By You

You may delete your account at any time via Settings → Account → Delete Account inside the App.

Upon deletion:

• Your personal data is removed within 30 days
• Shared expenses remain visible to participants but your name is anonymized
• Outstanding debts should be settled before deletion
• Your FCM token is immediately removed from our servers

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse other users
• Fail to comply with applicable laws

We reserve the right to refuse service to anyone for any reason.

Effect of Termination

Upon termination, your license to use the App ends immediately. Provisions regarding liability, indemnification, intellectual property, and dispute resolution survive termination.

Modifications to Terms

We may update these Terms at any time. Changes are effective upon posting in the App or notification via email or in-app message. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the App and delete your account.

Dispute Resolution

Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

Resolution Process

Any disputes shall be resolved through:

1. Good faith negotiations (contact support@svnate.com first)
2. Binding arbitration if negotiations fail, conducted in Pune, India

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

Jurisdiction

For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts in Pune, Maharashtra, India.

Specific Feature Terms

Friend Connections

• Friend requests can be sent to registered users
• You control who can find you via Privacy Settings
• Removing a friend does not delete shared expense history

Group Expenses and Trips

• Group creators are responsible for accurate split calculations
• All participants must verify expense details
• Changes to group expenses notify all participants

Notifications

By using the App, you consent to receive push notifications about friend requests, expense updates, payment reminders, and app updates. You can manage notification preferences in Settings or your device's notification settings.

QR Code Sharing

• QR codes are generated for sharing expense or profile information
• You are responsible for controlling QR code distribution
• QR codes may expire or be invalidated

AI Features

• AI categorization and insights are automated and may not always be accurate
• You should verify all AI-generated suggestions before acting on them
• We are not liable for decisions made based on AI-generated content

Offline Mode

• Limited functionality is available offline
• Data syncs automatically when internet connection is restored
• We are not liable for data loss in offline mode

In-App Tutorial

• A feature tutorial is shown to new users on first login
• Tutorial completion is tracked locally on your device
• You may skip the tutorial at any time

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trackate
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect
• Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not assign these Terms. We may assign our rights and obligations to a successor entity
• Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control
• Language: These Terms are written in English. The English version prevails in case of any conflict with translations

Acknowledgment

By downloading, installing, or using Trackate, you acknowledge that:

• You have read and understood these Terms of Service
• You agree to be bound by these Terms
• You have read our Privacy Policy
• You are of legal age or have parental/guardian consent
• You are authorized to enter into this agreement
